Terms and Conditions

Coverage Period:
Sensus and ErgoSoft foam products manufactured by Foamex, Inc. are guaranteed to retain at least 90% of original loft for a period of up to 10 years, covering the average life of a mattress topper.

Exclusions:
Warranty is limited to described Foamex products only. Foamex is not responsible for any subsequent damage if product is abused or misused in any way, or exposed to any liquids or chemical products.

Right of Inspections:
Foamex reserves the right to inspect all mattress toppers involved in warranty claims. All inspections will take place at the designated customer’s manufacturing facility.

Claim Limitations:
This warranty is limited to Foamex materials only. Any and all subsequent materials, labor and/or freight and/or delivery charges are not covered under warranty.

Warranty coverage is limited to original purchaser.

Perfect Comfort Mattress 10 Year Limited Warranty
We hereby warrant your new mattress against defects and workmanship except damage caused by misuse or abuse, accident, neglect, carelessness, alteration to the product, or any other conditions that are beyond the control of the manufacturer.

In the event that service resulting from such defect is required during the warranty period, your mattress will be repaired or replaced using the scale below. The warranty starts with the date of original purchase.

Purchase receipt required to demonstrate original purchase date. This warranty provides you with specific legal rights. You may have additional rights which may vary from state to state.

First 2 years coverage 100%
Year 3-10 coverage is 50% of current retail

Transportation costs to and from the point of repair are the responsibility of the consumer.

Body impressions are normal resulting from conforming of cushioning material to the sleeper and are not considered a warranty issue.

Perfect Comfort 3" and MemorRest 2" Mattress Pad Five-Year Warranty
US Memory Foam (USMF) warrants to the original purchaser or user that the accompanying product will be free from defects in materials and workmanship for a period of 5 years from the date of the original retail sales invoice. If during the warranty period, this product is found to be defective because of defects in materials or workmanship, it will be replaced without charge. Notice of a claim under this warranty must be given promptly in writing, in no case later than 45 days after the purchase of the product. Defective products must be returned, along with the invoice, prepaid to USMF at the address stated below. USMF will prepay shipping charges for the replaced product. This warranty will become void if the product shows signs of careless handling or if the product is ripped or torn. In addition, this product must be protected during use by a quilted mattress cover, and all cleaning must be done in accordance with USMF care instructions.

Except as set forth above, USMF MAKES NO OTHER WARRANTIES, EITHER EXPRESS OR IMPLIED, INCLUDING THE IMPLIED WARRANTIES OF MERCHANTABILITY OR FITNESS FOR A PARTICULAR PURPOSE. IN NO EVENT WILL USMF BE LIABLE FOR INCIDENTAL OR CONSEQUENTIAL DAMAGES OF ANY KIND, whether such damages are claimed on account of breach of warranty, breach of contract, negligence or strict product liability, including without limitations, damage to property or other economic losses.This limited warranty gives you specific legal rights and you may also have other rights which vary from state to state. UNPACK CAREFULLY This mattress memory foam mattress pad has been vacuum packed and compressed for shipping. It looks smaller in the package than it really is. Open the package carefully, taking care not to cut or tear the mattress pad. Within six hours after the pad is released from the packaging and allowed to breathe, it will assume its proper size. The slight scent of "newness" that all foam products have will dissipate gradually.

INSTALL PROPERLY Place the mattress pad on top of your mattress. A quilted cotton mattress cover should be placed over your memory foam mattress pad. Place your regular sheets on top of the quilted mattress cover. With all memory foam products, cotton sheets are preferable.

WARNING: URETHANE FOAM IS FLAMMABLE. Do not expose urethane foam to open flames or any other direct or indirect high temperature ignition sources such as burning operations, welding, burning cigarettes, space heaters or naked lights. Once ignited, urethane foam will burn rapidly, releasing great heat and consuming oxygen at a high rate. In an enclosed space, the resulting deficiency of oxygen will present a danger of suffocation to occupants. Hazardous gases released by the burning foam can be incapacitating or fatal to human beings if inhaled in sufficient quantities.

Sleep On! 20 Year Limited Warranty

The purchase of your new Sleep On! Mattress Pad is quality-assured to be free from defects in materials and workmanship.

Your warranty starts with the date of original purchase. The original purchase receipt is required to demonstrate purchase date. This warranty provides you with specific legal rights. You may have additional rights which vary from state to state.

Body impressions on your new mattress pad are normal and indicate that the cushioning layers are conforming to your body contours. Impressions up to two inches should be expected and are not a suggestion of structural failure.

Replacement or repair of your Sleep On! Mattress Pad will be done with exact materials if available but we reserve the right to substitute with materials of equal or higher value.

Mattress fabric is not covered under this warranty.

A quality bed frame is required for this warranty to be effective. A center-support must be
present under the Queen and King sets.

This warranty is provided to the original purchaser only and is not transferable.

We reserve the right to refuse service if a product is found to be soiled or unsanitary.

Transportation costs to and from our facility are the responsibility of the consumer.

Please allow one-three weeks after the product is received into our facility.

In the event that service resulting from such defect is required during the warranty period, the product will be repaired or replaced using the scale below.
